Probate Services

Please note the Practice will be relinquishing its Probate Licence with effect from 1 January 2025 and therefore will be unable to accept any new instructions for this service

As accountants able to provide probate services, we are able to deal with all aspects of Probate and Estate Administration which includes:

  • Researching and assessing the value of the deceased's Estate
  • Preparation of the Inheritance Tax accounts
  • Dealing with Income and Capital Gains Tax liabilities of the Estate
  • Gathering assets and paying off any creditors
  • Advising beneficiaries and executors of the tax implications connected with selling any assets
  • Preparation of thee tax returns for personal representatives
  • Providing final Estate accounts

Probate and Estate Administration Pricing

It is difficult to provide cost figures as every case is different and will inevitably require a different time input.

James de Frias Limited bases it's charges on the time costs involved and not on a set fee or percentage of the estate basis. However, we will guarantee that no fee will be in excess of 1.5% of the Probate Value of the Estate

Our hourly charge out rates for individuals are in the range of £60 to £150, dependent upon experience.

The reason we do not charge set fees or use the percentage basis is that two estates of similar value may involve significantly differing time costs to complete.

However, we do not expect potential clients to commit without knowing the likely costs involved so we will provide an estimate based on information available at the time relating to the estate.

VAT at the ruling rate will be added to our time costs, together with any disbursements incurred.

Examples of increased costs

  • The estate is taxable so full inheritance tax returns must be submitted to HMRC
  • The number of properties as associated transfer costs will apply
  • Business assets / non listed shareholdings
  • Intangible assets
  • Lack of a valid Will It is our experience that by charging on an actual time costs basis that our charges will be less than those organisations who charge a straight percentage of the value of the estate, or a base fee plus a percentage.

Unlike many other organisations we do not charge a fee should we be appointed executors or requested to take on such an appointment.

Expected Timescales of the Service

It is always difficult to predict how long it will take to complete this matter but as a general guide we would provide an estimate of the timeframe for this matter to be anything from 9 to 12 months, provided we do not encounter any difficulties or delays but as matters progress we would hope to be in a position to give you a more accurate timescale

Additional Services

We can also arrange for professional valuations to be carried out on property, jewellery and works of art. This is an area where Probate is often held up, however, we will ensure that the valuations are carried out quickly and do not hold up the process in any way.
